Intelligency (ABN 44 856 032 091) is an AI-native brand and marketing agency based in Perth, Western Australia. This privacy policy explains how we collect, use, disclose, and protect personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

In this policy, “we”, “us”, and “our” refer to Intelligency. “Personal information” has the meaning given in the Privacy Act 1988 and includes any information or opinion about an identified individual, or an individual who is reasonably identifiable.

2. What personal information we collect

We only collect personal information that is reasonably necessary for our business functions. The types of information we may collect include:

  • Contact form and enquiry submissions — your name, email address, company name (if provided), areas of interest, and any message content you submit through our website contact forms or AI automation enquiry forms.
  • Analytics and usage data — information automatically collected when you visit our website, including pages visited, time on page, referral source, device type, browser type, screen resolution, approximate geographic location (city/country level, derived from IP address), and interaction events. This data is collected via Google Analytics and Vercel analytics tools (see section 5).
  • Communication records — the content of emails and other correspondence if you contact us directly outside the website.

We do not collect sensitive information (such as health, racial, or biometric data) through this website.

3. How we collect personal information

We collect personal information in the following ways:

  • Directly from you — when you fill out a contact form, submit an enquiry, or correspond with us by email.

Where practicable, we will collect personal information directly from you. We do not purchase personal information from data brokers or third-party lists for the purposes of this website.

  • Vercel Inc. (USA) — website hosting, deployment, and performance analytics (Vercel Speed Insights). Vercel processes server logs that may include IP addresses and request metadata.   • Resend Inc. (USA) — transactional email delivery service. When you submit a contact or enquiry form, your name and email address are processed by Resend to deliver the submission to us. Resend’s privacy policy is available at resend.com/legal/privacy-policy.

We take reasonable steps to ensure that these service providers comply with obligations comparable to the Australian Privacy Principles. However, under APP 8.1, once personal information is disclosed to an overseas recipient, we may not be able to ensure compliance and may not be accountable under the Privacy Act for any acts or practices of the overseas recipient.

6. Cookies and tracking technologies

Our website uses cookies and similar technologies for the following purposes:

  • Analytics cookies — set by Google Analytics to distinguish unique users and sessions. These cookies do not contain personal information but generate pseudonymous identifiers.
  • Essential cookies — required for the website to function correctly (e.g. form submission state).

As an AI-native agency, we use artificial intelligence tools in our internal workflows, including for website development, content creation, and business operations. These tools process our internal code and content — they do not have access to personal information submitted by you through our website forms. Your form submissions are handled solely through the email delivery pipeline described in section 5 and are not processed by any AI system.

9. Your rights under the Privacy Act 1988

Under the Australian Privacy Principles, you have the right to:

  • Access — request access to the personal information we hold about you (APP 12)
  • Correction — request correction of personal information that is inaccurate, out of date, incomplete, irrelevant, or misleading (APP 13)
  • Erasure — request deletion of your personal information where we no longer need it for the purpose it was collected
  • Withdraw consent — withdraw your consent to any future communications at any time

10. Complaints
